Purpose and legal basis for processing
 
GF Building Flow Solutions collects personal data about the user (“User”) of (“Application”). Personal data can only be processed for a specific purpose under a valid legal basis. The user of the Application may be a representative of a company or other legal entity and the register may also contain personal data of respective companies or customers of relevant legal third parties and other third parties, if the user has provided such personal data to Uponor within the Application.
 
The purpose of the use of the personal data is to provide the user with the Application as agreed between the user or the company/other legal entity the user is representing and GF Building Flow Solutions. The personal data may also be used for the below listed purposes
 
  • performing GF Building Flow Solutions’s obligations towards the user and handling, evaluating, and enforcing user’s or GF Building Flow Solutions’s obligations or liabilities
  • managing, handling and submitting offers and quotations as well as other binding or non-binding documents;
  • exercising GF Building Flow Solutions’s rights,
  • managing and handling customer loyalty programs;
  • provision of GF Building Flow Solutions products and services to user and ensuring quality, functionality and security of the products and services;
  • maintenance and development of the Application and GF Building Flow Solutions products and services;
  • marketing and communication purposes such as conducting marketing research, direct marketing, automated marketing, informing the user of new features, new products or launches, and special promotions.
 
The legal basis for processing the user’s personal data is the performance of the agreement between the user and GF Building Flow Solutions concerning the use of the Application and the services it provides (see article 6.1(b) of the EU General Data Protection Regulation 2016/679, the “GDPR”). In some instances, GF Building Flow Solutions may also process the user’s personal data based on its legitimate interests to analyse how the Application is used, further develop it, and make recommendations of other suitable services to the customer as part of the same customer group (see article 6.1(f) of the GDPR).
 
In the event that the User has self-submitted personal data concerning the User’s end customers to the Application, the legal basis for GF Building Flow Solutions to process such data is its legitimate interests in providing the Application (and the services provided thereby) for the benefit of the end customer in question. GF Building Flow Solutions may also process such data for its legitimate interest to analyse how the Application is used, further develop it, and to market its products and services. (See article 6.1(f) of the GDPR).
 
To the extent the user adds any such personal data of the User’s end customers into the Application, the User should inform the customer of this and direct the end customer to this privacy policy.
 
Types of personal data processed
 
Personal data is collected when the user downloads, installs and uses the Application or otherwise interacts with GF Building Flow Solutions. Personal data collected and/or processed may include
 
  • The User’s full name
  • User address (street, number, post code, city)
  • Mobile number
  • Email address,
  • Area/county and country.  
 
Personal data may include User submitted information that may be used to identify them including:
 
  • the User’s customer number 
  • User submitted photographs User projects, 
  • IP-address, access times,  
  • Platform usage by the User, such as links, content and other behavioural information relating to the user that GF Building Flow Solutions receives through the Application.   
How is your personal data processed?
 
The personal data is collected primarily from the user of the Application or through the User’s actions within the Application.
 
If the User has registered or signed in to “GF Building Flow Solutions & More Loyalty Program”, the user’s personal data can be also collected and processed through the GF Building Flow Solutions & More Loyalty Program database.
 
 
Regular disclosure of data and the transfer of data outside the EU or the EEA
 
GF Building Flow Solutions may use third-party service providers to process personal data. GF Building Flow Solutions may disclose and transfer personal data outside EU/EEA in accordance with and subject to the limitations imposed by applicable legislation as follows:
 
  • to companies belonging to the GF Building Flow Solutions Group in accordance with a contract entered into between the relevant GF Building Flow Solutions entities, incorporating the European Commission’s Standard Contractual Clauses, which ensure that adequate data protection arrangements are in place
  • to authorized third parties to the extent they participate in the processing of personal data for the purposes stated in this personal data policy. The personal data may be processed by such authorized third parties also outside EU or EEA in accordance with a contract entered into between GF Building Flow Solutions and such authorized third party, incorporating the European Commission’s Standard Contractual Clauses, which ensure that adequate data protection arrangements are in place. GF Building Flow Solutions shall oblige such third parties to keep confidential and adequately secure any such transferred personal data; or
  • based on consent; or
  • as otherwise permitted by applicable legislation.
 
For technical reasons and for reasons related to the use of data, the personal data may be stored on servers of external service providers who may process the data on behalf of GF Building Flow Solutions.
 
In addition to the above GF Building Flow Solutions may be obliged to disclose the personal data to the authorities. GF Building Flow Solutions may also disclose and otherwise process the personal data, in accordance with applicable legislation, to defend its legitimate interests.
 
Any transfers of personal data shall be made in accordance with the General Data Protection Regulation (2016/679) and any applicable mandatory legislation, as may be amended from time to time.
 
 
Principles of data security and data storage
 
GF Building Flow Solutions shall ensure that sufficient technical and organizational personal data protection measures are implemented and maintained throughout its own organization. Further, GF Building Flow Solutions shall ensure that any transfer or disclosure of personal data described in this privacy policy to any third party is subject to GF Building Flow Solutions having ensured an adequate level of data protection by agreements or by other means required by law.
 
Technical controls:
Physical material is stored in locked spaces with restricted access. Any IT systems are secured by means of the operating system’s protection software. Access to the systems requires entering a username and a password and data transfers happen via high encryption channels.
 
Organizational controls:
Within the organization of GF Building Flow Solutions, the use of the personal data is instructed, and access to IT systems including personal data is limited to such persons who are entitled to access them on the basis of their work assignments or role and who are subject to confidentiality obligations regarding the personal data.
 
GF Building Flow Solutions retains the personal data as long as it is necessary for the aforementioned purposes or as required by applicable laws. When such requirements no longer exist, the personal data will be deleted.
 
Data subject’s rights
 
As a Data Subject, the User has the following rights regarding the personal data processed by GF Building Flow Solutions in the usage of the app:
 
  • The right to access all personal data GF Building Flow Solutions have on them.
  • The right to request that GF Building Flow Solutions corrects, erases, or stops using any erroneous, unnecessary, incomplete, or obsolete personal data.
  • The right to withdraw any consent previously provided by them for the use of the app
 
The user may exercise these rights by using the forms provided on https://www.uponor.com/en-en/legal-information/data-protection, Including options for your local language. GF Building Flow Solutions processes all requests as soon as possible.
 
If dissatisfied with the decisions or actions of GF Building Flow Solutions, the user has the right to lodge a complaint with their local data protection authority.
 
 
Privacy Statement changes
 
GF Building Flow Solutions reserves the right to amend/update this Privacy Policy as necessary and in accordance with our processing activities. Updates to this Privacy Statement will be posted on our website, the relevant app store and the user will be notified as appropriate. Material updates to the privacy policy will be effective from the data set out at the beginning of the privacy policy.
